How long does the divorce agreement process take?

An amicable divorce in court can be concluded in 1–3 months, provided that the spouses have an agreement on child custody, alimony, and property division. PM Attorneys assist in drafting the agreement and representing you at the hearing.

Who gets custody of the children in a divorce?

The court always decides in the best interests of the child. In practice, joint parental care is favoured. If the parents do not agree, the court decides based on all circumstances – financial situation, the child's attachment, the parents' capabilities, and the opinion of the social work centre.

What are marital assets and how are they divided?

Marital property is assets acquired through work during the marriage. The presumption is that each spouse has an equal share (50/50), but a different contribution can be proven. Property acquired before marriage or by inheritance is not marital property.

Who are the legal heirs and what is the order of succession?

Legal heirs are classified into inheritance orders: the first order comprises descendants and the spouse, the second order parents and the spouse, the third siblings and so on. A will can alter the legal order of succession, but it cannot exclude forced heirs.
