What should I do if the police ask me to come in for a statement?
Engage a lawyer immediately before the hearing. You have the right to remain silent without a lawyer present. Any statement made without a lawyer can be used against you. Contact PM Advokate – we are available urgently.
Can I be arrested without a charge?
Yes – the police can detain a person for up to 48 hours. During this period, the prosecutor can request detention from the court. A lawyer must be informed immediately and attend the hearing. Do not delay calling a lawyer.
How long does a criminal procedure last in Serbia?
The duration depends on the complexity of the case. Simpler procedures can be concluded in 6-12 months, while complex cases (economic crime, organised crime) can last for several years, including appeal proceedings.
Can an agreement be reached with the prosecution?
The Criminal Procedure Code of Serbia provides for the possibility of a plea agreement between the defendant and the prosecution. An agreement can result in a significantly lighter sentence.
